GENERAL TERMS AND CONDITIONS (AGB’s)

1 – General Provisions: MW Personal Training GmbH (“MW”) provides services in the area of ​​health and fitness oriented personal training as well as nutritional advice / sports nutrition. These services serve to promote health, performance and general well-being.

2 – Health Questionnaire:  A health questionnaire must be completed by the Client before the first training session. The Client promises to answer all questions truthfully. The information is used to assess the current state of health of the Client. If something changes in the state of the Client’s health, MW must be informed forthwith in writing.

3- Registration and Contract:  Registration with a selected subscription to is made in writing by means of a contract between the Client and MW and is binding.

4 – Terms of payment:  Payment is made with a payment slip or e-banking before the beginning of the training. If the payment is not received in time, MW reserves the right to cancel the training session and the contract.

5 – Validity and Duration of Subscriptions: A. 12 session subscription to be fully used within 4 months from the date of the first session;  B. 24 session subscription to be fully used within 7 months from the date of the first session; C. 48 session subscription to be fully used within 12 months from the date of the first session. No monetary refund will be made for unused lessons.

6 – Missed Lessons and Absences:  Cancellations of lessons must be communicated to MW at least 24 hours in advance. Later cancellations will be charged in full.

7 – Termination in case of illness or accident: If a subscription cannot be redeemed due to the illness or an accident of the Client, it is possible upon presentation of a medical certificate to redeem the balance of the subscription at a later date, but no later than 12 months following the end of medical interruption as specified on the medical certificate. No monetary refund will be made for unused lessons after this date.

8 – Vacations and Absences: Client and MW undertake to inform each other as far possible in advance of their respective planned absences and vacation dates.

9 – Data Protection:  The Client agrees that any collected data from the Client can be used by MW for training and necessary business related matters. The data will be treated confidentially in compliance with applicable law.

10 – Law and Jurisdiction:  All legal matters between Client and MW Personal Training GmbH are subject exclusively to Swiss law and Swiss courts. Jurisdiction is Cham, Kanton Zug.

With the signature of this contract, the foregoing Terms and Conditions are accepted in full by the Client.
